The Uttar Pradesh Electricity Regulatory Commission (UPERC) has dismissed a petition filed by U.P. Rajya Vidyut Utpadan Nigam Limited (UPRVUNL) seeking regulatory intervention and an enabling framework for the integration, recognition and tariff treatment of Battery Energy Storage Systems (BESS) with thermal power stations.
The matter was registered as Petition No. 2375 of 2026 and was heard by the Commission on 11 August 2026. UPERC issued its order on 14 August 2026, dismissing the petition in limine. The order has been published on the Commission’s official orders portal.
UPRVUNL’s Request
UPRVUNL approached the Commission seeking regulatory intervention in the Uttar Pradesh Electricity Regulatory Commission (Terms and Conditions of Generation Tariff) Regulations, 2024.
The petition sought an enabling framework to facilitate the integration, recognition and tariff treatment of BESS with thermal power stations. UPRVUNL also sought alignment of the applicable regulatory framework in Uttar Pradesh with the framework prescribed by the Central Electricity Regulatory Commission (CERC).
The petition was filed under provisions of the Electricity Act, 2003, including Section 181 and Section 61, as recorded in the Commission’s order.
UPRVUNL requested the Commission to admit the petition and issue appropriate orders or directions for the proposed framework pending formal amendment of the applicable regulations.
Proceedings Before the Commission
The petition was considered by a three-member bench of UPERC comprising Arvind Kumar, Chairman; Sanjay Kumar Singh, Member; and Griesh Kumar Vaish, Member (Law).
The hearing took place on 11 August 2026, with representatives appearing for the concerned parties. During the proceedings, the petitioner’s submissions regarding the need for an enabling regulatory framework for BESS integration with thermal power stations were considered by the Commission.
The case was subsequently decided through UPERC’s order dated 14 August 2026.
UPERC’s Decision
After considering the petition, UPERC did not grant the regulatory intervention sought by UPRVUNL.
The Commission observed that it may initiate a process for bringing an enabling regulatory framework for the integration, recognition and tariff treatment of BESS with thermal power stations, following due consultation with stakeholders, as and when the Commission considers appropriate.
However, UPERC held that a legislative change could not be brought about on the judicial side of the Commission through an individual petition.
On this basis, the Commission dismissed Petition No. 2375 of 2026 in limine.
Regulatory Framework to Be Considered Separately
While dismissing the petition, UPERC’s order records that the Commission may consider initiating the appropriate process for an enabling regulatory framework at a later stage, following stakeholder consultation and in accordance with the Commission’s regulatory process.
The order therefore does not introduce the requested changes to the Uttar Pradesh Electricity Regulatory Commission (Terms and Conditions of Generation Tariff) Regulations, 2024 through Petition No. 2375 of 2026.
The Commission’s decision specifically relates to the manner in which the requested regulatory change was sought through the present petition. Any future regulatory process would be undertaken separately by the Commission, if and when considered appropriate.
UPERC’s order concludes the proceedings in Petition No. 2375 of 2026, filed by UPRVUNL for regulatory intervention concerning the integration, recognition and tariff treatment of BESS with thermal power stations.
The petition has been dismissed in limine, while the Commission has recorded that it may consider an appropriate regulatory process for the subject after due stakeholder consultation. The order dated 14 August 2026 is available through UPERC’s official orders portal.
